In some instances, it may not even be necessary to go to Court as we have had success in having a debtor pay up at the Letter Of Demand stage.

The Letter of Demand also points out to the debtor that if the matter goes to Court, there will be an additional amount added to the amount owed. These amounts include a large portion of your legal fees, interest and any other amounts associated with serving documents on your debtor.

The work that we do for you ranges from the Letter of Demand stage, lodging a Statement of Claim in the appropriate Court and obtaining Judgement.

Where the debtor does not satisfy the debt following judgement, we develop the best strategy for recovery including garnishee of wages, bank accounts and in some instances obtaining a writ against the debtor’s real or personal property.

Is debt recovery expensive?

The initial process of debt recovery is relatively inexpensive, for example, a Letter of Demand is as little as $350. A well drafted letter of demand shows your debtor you are serious about recovery and it also lets them know that they will be up for other costs, such as your legals and interest accrued on the amount owed.

What is the success rate of debt recovery?

Debt recovery progresses in stages with varying degrees of success at each stage. We have had a success rate of 75% to 80% in most matters.

What is the difference between a Letter of Demand and a Statement of Claim?

A Letter of Demand is to let the debtor know you are coming for them, whereas a Statement of Claim commences the legal process of recovery via a Court which happens if the debtor does not respond to the Letter of Demand.

Do I need to come to your office?

The process of debt recovery can begin with a simple phone call to us, followed up by emails but you can attend our office if it best suits you.

Do I need to pay any money up front?

We do not charge anything for our initial consultation with you and you pay us for the Letter of Demand when completed, which also includes any negotiation with the debtor. We recover our legal fees from the debtor where the matter is successful in Court.
